If you’re going through a divorce, you have a lot on your mind. Often, personal concerns like a name change might take a backseat to issues like finances and children. However, our experienced Marlton divorce attorneys at Weinberg, Kaplan, & Smith, P.A., have the compassion and commitment to take on those pressing matters while guiding you smoothly through the name change process.
Requesting a Name Change in Your Initial Filing
In most circumstances, the best approach to requesting a name change in divorce is to do so in the relief requested in your Complaint or Counterclaim for Divorce. However, the nature of your separation, timing of your request, and other circumstances may change how and when your name is changed. This can mean more documents, more time, and more money spent if not approached properly.
New Jersey is More Flexible
New Jersey is often more flexible when it comes to changing your name during divorce than many other states are. In fact, either spouse or both spouses can typically request a name change. Additionally, a name change during the divorce process usually offers a variety of options:
- Returning to your maiden name, which is the surname you were born with
- Returning to the name you had prior to marriage, if it’s not your maiden name
- Choosing a new name altogether, within certain parameters
It’s important to note that the matter of changing your name in a divorce is entirely up to you. This means that your divorcing spouse cannot compel you to drop their last name.
After Your Name is Changed
Once the court approves your request for a name change and your divorce is finalized, you will need to make your name change official. At a minimum, this involves updating your records with the Social Security Administration and the NJ Motor Vehicle Commission. You should also update your additional accounts with your new name, including bank accounts, credit cards, subscriptions, medical offices, and your Passport.
